Insurance is a necessity for the majority of Ohioans. When you initiate an insurance policy, you are entering a contractual agreement designed to provide you protection in the event of an unexpected occurrence. Although these contracts tend to be lengthy and exhaustive, it is possible that certain aspects may be subject to interpretation.

Insurance is used in dozens of everyday applications, some of which include:

  • Auto
  • Health
  • Disability
  • Employer Liability
  • Homeowner
  • Life
  • Professional liability
  • Renters

When an action occurs that prompts a claim, you may try contacting the company’s customer support, a support supervisor, the claims department, or reach out to your agent (if applicable). Once the communication has escalated without a resolution, it may be time to seek legal representation. Attorneys who address cases where an insurance company fails to honor their contracted obligations may be involved in different aspects of law---some of these may include employment, real estate, health, or perhaps personal injury.

Types Of Disputes

personal-injuryWhen an insurance company is believed to have not fulfilled their obligations, this is referred to as a breach of contract. If you file a claim with your insurer, they may indicate that coverage is unavailable or subject to exclusion, and issue a denial. Under Ohio law, insurers are supposed to extend coverage by allowing the policy holder the benefit of the doubt in many cases. This is generally referred to as acting in good faith. To prove that an insurer acted in “bad faith” requires proving they failed in their duty to demonstrate “reasonable justification” in their decision. Sometimes those filing a claim report that the insurer seemed to continue to delay, stating the claim is being reviewed and using tactics such as requesting that you resubmit.
