People v. Anonymous (Roch. City Ct., 3/17/17)

Mr. Corletta’s quick recognition of an extremely complicated legal issue, and correct application of the law, saved his truck driver client's license to operate a commercial motor vehicle in People v. Anonymous (Roch. City Ct., 3/17/17).

          In that case, the client was charged with 2 traffic violations, as well as Unlawful Transportation of a Person in a Vehicle used for Interstate Commerce, which is a crime. The arresting officer however, divided the charges, sending the 2 traffic violations to the local city Traffic Violations Bureau, and the criminal charge to Rochester City Court.

          Mr. Corletta contested the 2 traffic tickets in the Traffic Violations Bureau, and obtained an acquittal on one of them after trial. Upon appearing in Rochester City Court, Mr. Corletta recognized that the criminal charge had been split off, and was part and parcel of the same incident which had already been tried in the Traffic Violations Bureau. 

          Recognizing Double Jeopardy violation, upon which he had obtained a prior precedent in a similar situation. Mr. Corletta pointed this out to both the District Attorney and the Court. The Court immediately suggested an Adjournment in Contemplation of Dismissal, which would not implicate the client’s license or record. As a result of his quick recognition of a complicated legal issue, Mr. Corletta prevented sure revocation of his client's license to operate a Commercial Motor Vehicle, which is the client’s livelihood.
