People v. Anonymous (2/7/17)

          The client, on probation for violating an Order of Protection that was in place for Domestic Violence, allegedly committed another domestic violence-type offense against someone else, and faced two new proceedings, one in Criminal Court and one in Family Court in People v. Anonymous (2/7/17).

          The client was already on probation for violating an Order of Protection, and received a new Domestic Violence-type charge with another person and was in danger of being violated on probation. Moreover, 2 new Orders of Protection were put in place against the client, 1 in Family Court and 1 in Criminal Court.

          Mr. Corletta took immediate control of this chaotic situation by counseling the client to stay completely away from the new Complainant. The client advised Mr. Corletta the charges were without foundation. Mr. Corletta also directed the client to fully brief the Probation Officer. This avoided an immediate probation violation.

          Appearing in Family Court, Mr. Corletta properly got the Family Court Petition dismissed, and that Order of Protection vacated. Appearing a few days later in Criminal Court, Mr. Corletta obtained the same result.

          In both cases, the Orders of Protection were vacated. Therefore, any basis for a probation violation disappeared. The client was able to maintain employment and housing.

          By his quick and decisive action, Mr. Corletta saved the client from spending at least one year in jail. Mr. Corletta counseled his client about any further contact with the Complainant, given that client was already on probation. The cases show how restrictive Orders of Protection can be, and the leverage they give to those who hold them, who at times, use them improperly.
