People v. F.K. (Roch. Cty. Ct., 8/24/16)

          Mr. Corletta notched his 18th consecutive victory in a contested criminal or DWI case in People v. F.K. (Roch. Cty. Ct., 8/24/16). In that case, the client, who was seeking to join the United States Armed Forces, was charged with Driving While Intoxicated, Aggravated Driving While Intoxicated, and three underlying traffic violations totaling 9 points. There was a motor vehicle accident involved.

          The police, thinking they had a so-called “slam dunk” case, prepared a virtually unintelligible accusatory instrument containing double and triple hearsay. Carefully analyzing the accusatory instrument and the various Supporting Depositions filed, Mr. Corletta exposed multiple defects in the document; most notably that the allegation regarding his client’s alleged operation of a motor vehicle was based upon double and triple hearsay, and never observed by the arresting officer. Mr. Corletta filed and served 4 separate Motions in the case, including 2 Motions to Dismiss addressing these defects, doing a great deal of work.

          The Court, after hearing Oral Argument, completely agreed with Mr. Corletta’s argument and dismissed all 5 charges, thereby clearing the client's path to joining the military, which would have been delayed for at least one year if the charges stood.

          Mr. Corletta’s client, eager to serve their country, was extremely grateful for all his hard work.

 

People v. T. C. (Roch. Cty. Ct., 8/25/16)

Mr. Corletta helped a client with a drug problem, and actually turned the client's drug problem into a favorable disposition in People v. T.C. (Roch. Cty. Ct., 8/25/16), thereby earning his 19th consecutive dismissal, reduction, or acquittal in a contested case.

The client was charged with 2 counts of Driving While Intoxicated with an alleged 15% BAC, plus Possession of a Hypodermic Needle and Drug Possession. By getting his client into treatment promptly, advising the Court and District Attorney of this fact, and advocating on his behalf, Mr. Corletta was able to obtain a reduction to a traffic infraction, provided the client completes a drug and alcohol treatment program that the client was already voluntarily participating in. This kept the client from having a criminal record, a drug-related conviction, and promoted the client's return to sobriety, all in “one fell swoop.”  Needless to say, the client was extremely grateful for this highly successful outcome.
