People v. S.R. (Canandaigua City Ct., 3/28/16).

Mr. Corletta saved his client’s job of over 30 years, by obtaining a not guilty verdict in People v. S.R. (Canandaigua City Ct., 3/28/16).

Mr. Corletta’s client was a 30+ year employee of a local school district. He had an exemplary employment record and had become a supervisor.

While working during the summer with a crew of custodians and some student interns, he made the mistake of making an inappropriate joke in front of a student intern. While admittedly exercising bad judgment, the matter was blown completely out of proportion, when two fellow employees, both of whom had been disciplined by the client for inadequate job performance, persuaded the student to tell the student’s parents, who then complained to the school district. This resulted in the client being suspended for close to a year. It also resulted in the client being arrested for Endangering the Welfare of a Child, although the 16 year-old intern showed no ill effects, and needed no counseling.

At trial, Mr. Corletta effectively cross-examined the People's witnesses, which included the two employees, and showed their bias and prejudice against his client. The Court found the client not guilty, echoing Mr. Corletta’s argument that while his client’s behavior may have been inappropriate or misguided, it was not criminal and did not warrant the sanctions he suffered.

As a direct result of Mr. Corletta’s hard work in a climate of “political correctness”, the school district was placed in a position where they were forced to reinstate the client’s job.  Certainly, this was no way to treat an employee who rendered 30 years of faithful and effective service..
