Being convicted of DWI carries many mandatory consequences; the most significant of which is installation of an Ignition Interlock device on any vehicle you own or operate. These devices have never been fully evaluated as to their reliability by New York Courts. Nonetheless, they are rarely questioned. They keep people from starting their vehicles by measuring blood alcohol from a breath sample given by the device. The vehicle will not start if even a small amount of alcohol is detected.

These devices are installed by certified installers, and the results of the tests are reported back to local probation departments, which monitor the results. If there is a positive test, which can come from either a stationary or rolling position, it is reported to the Court. The driver is then summoned back to Court to face a proceeding for violation of their sentence.

A reading of as low as .025%, the equivalent of one drink, can trigger the device. This can cause serious inconvenience to the client, unnecessary and expensive Court proceedings, and additional costs in having your vehicle towed and resetting the device.
